Guarantee

Associated Citrus Packers, Inc. hereby guarantees, as of the date of shipment, the following with respect to its produce:

1. Said produce has been grown by Associated Citrus Packers, Inc. under its supervision or control or by it’s growers. Associated Citrus Packers, Inc. and it’s growers guarantee the following with respect to produce delivered to Associated Citrus Packers, Inc.:

a) Said produce has been grown by the grower or the grower’s farm management company under his supervision and control;

b) Said produce has been ground irrigated using only Colorado River water delivered by one or more of the local Irrigation Districts;

c) Only pesticide chemicals authorized by all applicable State and Federal regulations have been used on said produce at authorized times and in conformity with the registration and label of the manufacturer and/or supplier;

d) If organic fertilizers such as manure have been utilized in growing said produce, only organic fertilizers that have been properly composted have been used;

2.  Said produce is not adulterated or misbranded within the meaning of the Federal Food, Drug and Cosmetic Act, 21 U.S.C. Sections 301 et seq. ("the Act"); 

3.  Said produce is not prohibited by the Act from being introduced into interstate commerce; 

4.Said produce is not adulterated or misbranded within the meaning of any applicable State food and drug law;

5.  Any pesticides or chemicals used by Associated Citrus Packers, Inc. on said produce comply with the rules and regulations of the Food and Drug Administration of the U.S.  Department of Health and Human Services and the U.S. Department of Agriculture and the Arizona Department of Agriculture.  Only pesticide chemicals authorized by all applicable State and Federal regulations have been used at authorized times and in conformity with the registration and label of the supplier; 

6.  Specifically for produce destined for the Japanese market, Associated Citrus Packers, Inc. certifies produce does not contain any prohibited chemicals, such as Difolatan (captafol), Plictran (cyhexatin),  Naphthaleneaceric acid, PCNB, and/or unauthorized chemicals in Japan; 

7.  Said produce is tested regularly by the Food and Drug Administration of the U.S. Department of Health and Human Services and FMC Food Tech, Riverside, California, the supplier of cleaning agents, waxes, and pesticide chemicals, to insure compliance with the rules and regulations applicable to post-harvest pesticide chemical residue levels; 

8.  At the time of packaging, said produce is marked by an identifying code that allows Associated Citrus Packers, Inc. to trace any package back to a specific grower/grove by ten (10) acre block should a specific package be the subject of a product recall.
